GENERAL TERMS AND CONDITIONS (GTC)
Effective date: June 19, 2026.
In operating the kalapom.com webshop, it is important to ensure the proper enforcement of consumer rights. The provisions of these Regulations do not intend to exclude or restrict consumer rights provided by mandatory Hungarian legal regulations. In case of doubt, the relevant provision must be interpreted in favor of the consumer.
I. GENERAL PROVISIONS AND SELLER'S DATA
These General Terms and Conditions (hereinafter: Regulations or GTC) govern the use of the webshop available at the internet address kalapom.com (hereinafter: Webshop), the process of placing orders, and the terms of the sales contract concluded between the Seller and the Buyer.

2. Basic Concepts:

BUYER (CUSTOMER): Any natural person, legal entity, or organization without legal personality who registers on the Webshop, places an order, or enters into a sales contract.

CONSUMER: A natural person who qualifies as a consumer under the Civil Code and Act CLV of 1997 on consumer protection (acting outside their profession, independent occupation, or business activity).

PRODUCT: Movable property available for purchase in the Webshop (especially straw hats and headwear). The displayed products are brand new.

PRICE: The gross consideration in Hungarian Forints (HUF) for the ownership of the product, including statutory taxes (VAT). If the Seller is VAT exempt (AAM), the price indicates the final amount payable. The Price does not include shipping costs, unless the Webshop provides free shipping for the specific order.

ORDER: The Customer's declaration of intent to purchase a product, which is submitted through the electronic interface of the Webshop, and creates a payment obligation on the part of the Customer.
3. Other provisions:
The acceptance of these Regulations is voluntary but is a mandatory condition for placing an Order. Contracts concluded in the Webshop are not considered written contracts; the Seller does not separately register them, and they are not accessible retrospectively (the Customer receives the content of the contract in the form of confirmation emails). The language of the contract is Hungarian.
II. ELECTRONIC SERVICES (WEBSHOP FUNCTIONS)

The Shopping Cart: A free technical service that allows selecting one or more products before placing an order. The Shopping Cart remembers its content for a maximum of 7 days but does not guarantee the future availability of the products.

Correction of data entry errors: The Seller continuously provides the Customer with the opportunity to review, modify, or remove products from the cart during the ordering process (until the "Order and Pay" button is pressed). In the event of an erroneous data entry (misclick), the Customer is obliged to immediately report the error to info@kalapom.com .

Customer obligations: The Customer is obliged to provide true and up-to-date information during the order. It is forbidden to disrupt the IT system of the Webshop, as well as to place unlawful content or content violating the rights of third parties (e.g., infringing comments).
III. CONCLUSION OF THE SALES CONTRACT

Order process: The Customer places the selected products in the Shopping Cart, provides shipping and billing information, selects the shipping and payment method, and then finalizes their offer by pressing the "Order and Pay" (or similar clearly labeled) button. This step implies a payment obligation on the part of the Customer.

Obviously incorrect prices: We do our utmost to ensure the accuracy of prices. If an obviously incorrect or disproportionate price appears in the Webshop due to a technical error (e.g., 0 HUF or 10 HUF for a premium hat), the Seller is not obliged to sell the product at the incorrect price. In this case, we will offer to fulfill the order at the correct price or cancel the order.

Confirmation and conclusion of the contract:

After placing the order, the system sends an immediate, automatic email confirming the receipt and verification of the order. This does not yet mean acceptance of the order.

The sales contract is concluded when the Seller explicitly confirms the feasibility of the order in a separate email (or in a shipping notification).

The consumer's obligation to offer ceases if the Seller does not confirm the offer within 48 hours.
IV. PAYMENT METHODS AND TERMS
In the Webshop, the Customer can choose from the following payment methods (the currently available options are shown on the Checkout interface):

Online credit card payment: Secure, via an external payment service provider (myPOS system).

Cash on delivery: Cash or card payment upon receipt of the package from the courier or at the parcel point.
Payment deadline: If card payment is chosen and the transaction is not successfully completed within 20 minutes of the order, the Seller is entitled to cancel the order and withdraw from the purchase contract.
V. DELIVERY TERMS AND PRICES

Delivery area: Products ordered in the Webshop are delivered to Hungary [and optionally: Romania].

Delivery methods: Home delivery by courier service, or delivery to a designated parcel point/automatic locker.

Delivery deadline: Delivery time is generally 2–5 business days, but no more than 14 business days from the Seller's confirmation of the order (and upon receipt of payment in case of advance payment).

Refusal of receipt for cash on delivery: If the Buyer repeatedly refuses or fails to accept a cash-on-delivery package, and the package is returned to the warehouse, the Seller is entitled to terminate the purchase contract and demand reimbursement from the Buyer for the direct shipping and return shipping costs incurred.
VI. CONSUMER RIGHT OF WITHDRAWAL (RETURN POLICY)
The Buyer, as a consumer, has the right of withdrawal without stating a reason within 14 days in accordance with Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses.

Withdrawal period: The withdrawal period begins on the day following the date of receipt of the product (or the last product in case of multiple products) by the Buyer or a third party designated by him.

Notification of withdrawal: The Consumer must notify the Seller of their intention to withdraw in a clear statement via email at info@kalapom.com or by post. The withdrawal form provided by law can also be used.

Return of the product: The Consumer must return the product within 14 days of notifying the withdrawal to the Seller's official return address: [Your return/warehouse address]. The direct cost of returning the product shall be borne by the Consumer.

Depreciation: The Consumer is liable for any depreciation resulting from use exceeding what is necessary to determine the nature, characteristics, and functioning of the product (trying on, fitting). The Seller may claim reimbursement for the depreciation of worn, damaged, or soiled hats.

Refund: Within 14 days of the package's return (or reliable proof of return), the Seller will refund the full amount paid by the Consumer, including the initial shipping fee (excluding additional costs due to shipping other than the least expensive standard shipping method). The refund will be made using the same payment method as the original transaction, unless the Consumer explicitly agrees to another payment method (e.g., bank transfer for cash on delivery).
VII. WARRANTY OF SUPPLIES AND MANDATORY WARRANTY
The Seller is responsible for faulty performance with a warranty and guarantee in accordance with the Civil Code (Ptk.) and relevant legislation.
1. Warranty for supplies:

In case of a product defect, the Buyer can enforce warranty claims (request repair, replacement, price reduction, or withdraw from the contract if the defect is not insignificant).

In the case of a consumer, the warranty claim expires within 2 years from the performance. In the case of a defect discovered within 1 year of purchase, it must be presumed that the defect existed at the time of performance, unless this presumption is incompatible with the nature of the goods or the nature of the defect. After 1 year, the burden of proof lies with the Buyer.
2. Mandatory Warranty:

Based on Government Decree 151/2003. (IX. 22.), the Seller is obliged to provide a mandatory warranty for durable consumer goods specified in the legislation (e.g., sunglasses, watches, jewelry), if their gross purchase price exceeds HUF 10,000.

The warranty period is tiered:

HUF 10,001 - HUF 250,000: 2 years

Above HUF 250,000: 3 years

For traditional clothing items (e.g., straw hats), there is no statutory mandatory warranty; the Buyer is entitled to the 2-year statutory warranty rights for these.
3. Complaint Submission:
The Buyer can submit quality complaints and warranty claims at info@kalapom.com. The Seller is obliged to substantively respond to and justify the complaint within 5 working days of receipt, and in the case of a consumer complaint, no later than 30 days.
VIII. DISPUTE RESOLUTION, CONCILIATION BODIES
The Seller strives to resolve disputes peacefully. A Buyer who qualifies as a Consumer may initiate proceedings before a Conciliation Body for out-of-court, swift resolution of consumer disputes related to product quality, safety, or contract performance.

Consumer Protection Authority: The Buyer can also submit a complaint to the Consumer Protection Department of the locally competent Government Office.
IX. SPECIAL RULES FOR COMPANIES (NON-CONSUMERS)
If the Buyer does not qualify as a Consumer (i.e., the purchase is made on behalf of a company, sole proprietorship, or other organization for business purposes):

The 14-day right of withdrawal without justification DOES NOT apply.

Pursuant to Section 8:1 (1) point 3 of the Civil Code, the statutory warranty claims are limited to 1 year, and the burden of proof rests with the corporate buyer from the moment of purchase.

The Seller's liability for non-intentional damages or lost profits to the corporate buyer is expressly excluded.

In case of any dispute, the parties submit themselves to the exclusive jurisdiction of the Hungarian court competent according to the Seller's registered office.
X. FINAL PROVISIONS
For matters not regulated in these Regulations, Hungarian legal provisions shall apply, in particular the Civil Code (Act V of 2013), Act CVIII of 2001 on electronic commercial services, and Government Decree 45/2014. (II. 26.).
